Welcome to Kayen Fitness. Thanks for being here — by using our website (kayenfitness.com) or our mobile app (together, the "Platform"), you agree to these Terms and Conditions.
1. Who we are
We are Kayen Fitness Ltd, a UK-based company.

2. Purpose of the Platform
Kayen Fitness is a matching and connection platform.
We help connect:
people looking for personal training ("Clients"); and
personal trainers ("Trainers")
We provide tools like profiles, messaging, and website/app forms to help users connect.
We are not a party to any agreement between a Client and a Trainer.
3. Beta Version & Matching
The Platform is in Beta / trial.
It is provided "AS IS" and "AS AVAILABLE".
Features may change, break, be removed, or be unavailable.
Matching and data:
Our matching algorithm is in a trial / learning phase.
We are collecting and using data to improve matching accuracy over time.
We do not guarantee that:
a match will be accurate;
a connection will be successful;
any Trainer is suitable for your needs.
Trainer vetting (best effort):
We use a best-effort approach to verify Trainer certifications and insurance (including reviewing documents during onboarding).
We do not guarantee:
ongoing validity of documents;
that a Trainer is safe, competent, or appropriate for you;
the quality, safety, legality, or outcome of any training services.
Your responsibility:
You are responsible for your own due diligence before meeting, hiring, or working with a Trainer (or any other user).
Kayen is not liable for the quality or safety of connections, introductions, or matches, or anything that happens between users.
Medical / professional advice:
Nothing on the Platform is medical advice.
We do not provide health, fitness, or medical services, and we do not supervise training sessions.
4. Payments
No payments are processed through the Kayen app or website (including website forms) during Beta.
Clients and Trainers must:
arrange, verify, and complete payments directly with each other; and
handle all payment terms off-platform (price, timing, cancellations, refunds, receipts).
Kayen is not a party to any payment agreement between users.
Kayen is not responsible for:
payment disputes;
chargebacks;
refunds;
non-payment;
scams; or
financial losses between users.
5. Founding Trainers Program
We may offer a Founding Trainers Program for Trainers who want early access and to help shape the Platform.
To apply (and to remain in the program), Trainers must provide:
valid, recognised certification(s); and
active public liability insurance (and/or equivalent professional liability insurance, as applicable).
Acceptance is at our discretion. We may accept/reject applications or remove Trainers from the program at any time.
Feedback and testimonials:
Founding Trainers agree to provide reasonable feedback (e.g., what’s working, what’s not, matching quality, usability).
We may ask Founding Trainers for testimonials/reviews/case studies (optional unless agreed in writing).
Fees:
The program is currently fee-free.
This may change with notice.
6. User Generated Content (UGC)
What counts as UGC:
Anything users post or share on the Platform (e.g., photos, messages, profile info).
Content standards (don’t post):
anything illegal, abusive, or offensive;
anything misleading or deceptive;
anything that infringes someone else’s rights (including IP/privacy/publicity);
viruses, malware, or harmful code;
anything that encourages self-harm or dangerous activity.
Moderation:
We may review, moderate, remove, and/or restrict access to UGC to:
enforce these terms;
comply with law; or
protect users and the Platform.
Reporting:
To report UGC, email contactus@kayenfitness.com (or use in-app reporting if available).
We aim to review reports and take appropriate action within 5 business days.
Licence (so we can run the Platform):
By posting UGC, you grant Kayen a non-exclusive, worldwide, royalty-free licence to host, store, use, display, reproduce, and distribute it as needed to operate, provide, improve, and promote the Platform.
You keep ownership of your UGC.
The licence ends when you delete your content or close your account, except where:
others have shared it and haven’t deleted it; or
we must keep it for legal reasons.
7. Content Ownership & Acceptable Use
Our content and IP:
Kayen branding and content (text, graphics, logos, trademarks, software, and website/app materials) belong to Kayen (or our licensors).
You must not copy, sell, distribute, or create derivative works from our content without permission.
Acceptable use (don’t do this):
scrape, crawl, or use bots/automated tools on the Platform or website without written permission;
try to access accounts/systems you’re not authorised to access;
introduce malware or do anything that compromises security;
interfere with or overload our tech;
post false or misleading information.
External links:
The Platform may include links to third-party sites.
We don’t control them and we’re not responsible for their content, availability, privacy practices, or terms.
8. Limitation of Liability
Using the Platform is at your own risk.
To the fullest extent permitted by law:
we are not liable for disputes, claims, injuries, damages, losses, or issues arising from interactions between users (including Clients and Trainers), even if the interaction started through the Platform;
we are not responsible for the quality, safety, legality, or outcome of training services provided by Trainers;
we are not liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, use, or goodwill).
Liability cap:
Our total liability to you for all claims related to the Platform is limited to the greater of £100 or the total fees paid by you to Kayen Fitness in the 12 months before the event giving rise to the claim.
Legal exceptions:
Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law.
Material changes (consumer opt-out):
If we make material changes to these terms and you don’t agree, you can opt out by stopping use and (where applicable) closing your account before the changes take effect.
9. Governing Law & Updates
Governing law:
These terms are governed by the laws of England and Wales.
Courts of England and Wales have exclusive jurisdiction.
Updates:
We may update these terms from time to time.
When we do, we’ll update the Effective Date at the top.
